Welcome to our website. This website is owned and operated by Rockwall Real Estate Group, brokered by eXp Realty (RREG). By accessing or continuing to use this website, you agree to be bound by these Terms of Service ("Terms"). These Terms apply to all website users, visitors, automated systems, and others who access the service without exception. If you do not agree with any part of these terms, you must immediately discontinue use of our website.

1. No Agency Relationship & Liability Disclaimer

• No Fiduciary or Agency Relationship: Your use of this website, its tools, contact forms, or data does not constitute or create an agency or broker-client relationship between you and RREG or any of its agents. RREG and its agents do not engage in unpaid, implied, or informal agency relationships.
• Notice of Non-Representation: These Terms serve as an explicit notice of non-representation and a termination of any perceived agency relationship between RREG and any consumer who has not executed both a formal, written representation agreement and a Texas Real Estate Commission Information About Brokerage Services (IABS) form.
• To Establish Liability: If you wish for RREG to assume professional liability, duty of care, or responsibility for data verification on your behalf, you must formally retain our services by entering into a signed, written agency relationship.
• Limitation of Liability: In the absence of a signed representation agreement, you understand and agree that all website data must be independently verified. You explicitly release RREG and its affiliates from any and all liability (whether perceived or actual). We are not responsible or liable for any financial loss or damage resulting from your reliance on data found on this website.

2. Automated Traffic, Scraping, and Bot Policy

We welcome legitimate search engines, indexers, and AI technologies that provide value, visibility, or traffic back to our platform. However, unauthorized extraction of our data is strictly restricted.

• Permitted Bots (Search & AI Placement): Automated web crawlers, spiders, and bots operated by recognized corporate entities—including but not limited to Google, Bing/Microsoft, OpenAI, and Anthropic—are permitted to crawl this site, provided their primary function is for indexing, SEO search placement, or conversational AI citation and placement that attributes data to RREG.
• Prohibited Bots & Scraping: All other automated traffic is strictly restricted. You may not use scrapers, spiders, data-mining tools, or proprietary scripts to harvest, extract, or scrape data, reports, or market information from this website for commercial resale, competitive analysis, or inclusion in third-party databases.
• Automated Spam Prohibited: The use of automated bots, scripts, or software to flood, submit, or harvest information from our contact forms is strictly prohibited.

3. Data Use & Intellectual Property Policy

Reports and data on our website may be reprinted, shared, or republished only under the following strict conditions:

A. Consumer Use

• Consumers are permitted to reprint and share data from our website for personal, non-commercial use.
• Doing so constitutes an agreement to hold harmless RREG in any and all circumstances related to data obtained from our site. Consumers should verify all data before making any real estate or financial decisions.

• Media organizations are permitted to use our reports and data, provided that RREG is explicitly cited and linked back to.
• Prior Contact Required: You must contact us prior to publication so that we are aware of the feature and can share your media posts.

4. Acceptable Use of Contact Forms

Our contact forms are intended strictly for legitimate real estate inquiries and media communication.

• Permitted Consumer Use: Consumers may use contact forms to request market information, property listing info, real estate sales data, equity reports, tax reports, and positioning reports.
• Permitted Media Use: Legitimate media inquiries are permitted.
• Prohibited Commercial & Solicitation Use: Commercial use of our contact forms for B2B marketing, sales pitching, or solicitation is explicitly prohibited. Please use proper legal and authorized channels to contact us.

Liquidated Damages for Commercial Spam

Any violation of this commercial solicitation policy will be subject to a $200 per-instance fee, plus a $50 CRM maintenance fee required to scrub your unsolicited commercial information from our database. By clicking "Submit" on any form for commercial solicitation purposes, you agree to pay this total fee of $250 per submission.

5. Privacy & Communication Consent

• Visitor Analytics: We do not collect personally identifiable information from casual site visitors, beyond standard data collected automatically by Google Analytics.
• Data Storage: If you choose to contact us via our website forms, your information is saved in our Customer Relationship Management (CRM) database. This information generally includes your name, phone number, email address, physical address, current realtor representation, buying/selling timeframe, and any other notes you provide.
• Consent to Contact: By submitting a contact form, you grant explicit permission to Rockwall Real Estate Group, brokered by eXp Realty, to contact you by phone, text, or email.
• Revocation of Consent: If you do not want us to contact you, we do not want to contact you. You can revoke this permission at any time. To opt-out, simply notify us via email, text message, phone call, or written letter, and your request will be honored promptly.

6. Changes to These Terms

We reserve the right to modify these terms at any time. Your continued use of the website after changes are posted constitutes acceptance of those modified terms.
